Domestic Assault, Abuse, and Violence Charges in Minnesota.
Domestic abuse is taken very seriously. And, for good reasons: Statistics show that as many as one in four relationships are affected by domestic violence. Additionally, if there is no intervention, there is a real risk of escalation. Therefore, the State and law enforcement take all abuse allegations seriously.
But reality is nuanced. Not all allegations are real. There are a variety of reasons someone may make false allegations and weaponize the system. Credible claims of self-defense may be overlooked. Even if partially true, allegations may be overly exaggerated.
Every case should be considered based on its unique facts, both sides of the story should be heard, and no person should be condemned based on statistics and assumptions that may not apply to their situation.
This is especially true given the long-lasting and wide-ranging consequences that follow a conviction for domestic violence. Depending on the severity of the case, the direct criminal consequences could be anything from a misdemeanor with minimal jail time up to a felony with the potential for multiple years in prison. Collateral consequences include severe immigration issues, prohibitions on possessing firearms, and custody and parenting time problems.
